Sri Laxmi Narasimha Mini Transport Owners Association v. The State Of Telangana,

W.P.No.16017 of 2015 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

"To issue an appropriate writ, order or direction more particularly a writ in the nature of Mandamus declaring the action of the respondents 2 and 3 from restraining the members of the petitioners to park vehicles beside Vijaya Laxmi Theatre is illegal, arbitrary and unconstitutional".

2. When the matter is taken up for hearing, the learned Government Pleader for Home has placed on record the written instructions dated 15.6.2015 furnished by the Sub-Inspector of Police, L.B.Nagar Police Station, Cyberabad Commissionerate, wherein it is stated as follows:

"It is respectfully submitted as per the records of L.B.Nagar Police Station revealed that no complaint or case whatsoever was registered against the petitioner's Transport Owners Association.

It is submitted that the allegation of the petitioner that the 2nd respondent has been interfering with the petitioner's business activities continuously is absolutely false and hence denied.

If any illegal parking is noticed by the authorities including Traffic Police, action will be taken by following the due procedure. Only to prevent the Law and Order authorities as well as the Traffic Authorities from acting in accordance with law, the petitioner on mere apprehension filed the

present writ petition".

3. On noticing the instructions, the learned counsel for the petitioner requested this Court to dispose of the writ petition by recording the instructions.

4. In view of the above, the writ petition is disposed of recording the above referred instructions dated 15.6.2015 furnished by the Station House Officer, L.B.Nagar Police Station, Cyberabad Commissionerate.
