THE HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 7801 of 2015 Order:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused, seeking to quash the proceedings pending against him in C.C. No. 1458 of 2013 on the file of the learned II Additional Chief Metropolitan Magistrate, Vijayawada, Krishna District, for the offence punishable under Section 498(A) IPC.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.

3. A perusal of the complaint prima-facie shows that there are direct and specific allegations against the petitioner/accused who is the husband of the de facto complainant. Even though the complaint was filed against the parents of the petitioner/accused also, but the police have deleted their names for want of evidence. In view of the nature of allegations made against the petitioner/accused in the charge sheet, I do not think it proper to quash the proceedings against the petitioner/accused. The Criminal Petition is devoid of merit and the same is liable to be dismissed.

4. Accordingly, the Criminal Petition is dismissed.

5. As a sequel thereto, the miscellaneous applications, if any, pending in the Criminal Petition shall stand closed. __________________ M.S.K. JAISWAL, J.
