THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36748 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 2 and 3 in interfering with the civil liberties of the petitioner and directing the petitioner to come to the police station everyday and detaining him for hours together, as illegal, arbitrary and violative of Article 14 of the Constitution of India.

Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner's wife is the owner of the some lands in their village and recently, the prices of the said lands have risen considerably. He further submits that some unscrupulous elements have tried to grab the said lands at cheaper rates and the petitioner and his wife have not agreed to sell the lands and thereafter, they approached the respondents 2 and 3 and with the influence of the said unscrupulous elements, the respondents 2 and 3 are calling the petitioner to the police station and forcing him to sell the said lands to the unscrupulous elements at cheaper rates and as such, the respondents 2 and 3 are interfering with the civil liberties of the petitioner and his wife.

Learned Assistant Government Pleader for Home (Telangana) submits that the respondents 2 and 3 are not interfering with the affairs of the petitioner and they are not forcing the petitioner to sell the lands to any persons.

Considering the rival submissions made by both the counsel, the respondents 2 and 3 are directed not to interfere with the civil liberties of the petitioner and his wife and also directed not to call the petitioner

to the police station. The respondents 2 and 3 are further directed to follow the due process of law laid down in Code of Criminal Procedure. The writ petition is accordingly disposed of.
