THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.29306 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents No.1 to 4 in interfering/harassing the petitioners without any crime is illegal, arbitrary, and violative of the Fundamental and Constitutional rights guaranteed & violative of Articles 14, 19, 21 & 300-A of the Constitution of India and consequently direct the respondents No.2 to 4 not to interfere and harass the petitioners by calling them to the Police Station without involvement of any crime." Heard Sri Muddu Vijai, learned counsel for the petitioners and learned Government Pleader for home for respondents, apart from perusing the material available before this Court.

A counter-affidavit is filed by the Inspector of Police, Banjara Hills Police Station, Hyderabad and paragraph No.6 of the said counter reads as under: "I humbly state and submit that earlier the 5th respondent herein had submitted a petition dt.26-08-2015 to the Hon'ble Home Minister for the State of Telangana requesting him to initiate action against the petitioners herein as they are continuously harassing and threatening them. Upon receipt of the said petition, the Hon'ble Home Minister endorsed it and forwarded the same to the Station House Officer, Banjara Hills Police Station, Hyderabad through proper channel for enquiry and necessary action.

Immediately, an entry was made into the Station General Diary and to know the veracity in the contents of the above petition submitted to the Hon'ble Minister, this respondent police summoned the petitioners as well as the complainant's party. Both parties approached this respondent Police Station and stated that they would compromise shortly but no action was taken on it. Later, on 07-09-2015 one Mr. One Sri G. Kevin (Srihari), President of Cinema Dancer and Dance Director of Telangana State (on behalf of the 5th respondent.

Cr.No.1057/2015 U/sec.506 IPC was registered on 26-09-2015 and taken up the investigation."

On noticing the averments in the above mentioned paragraph No.6 of the counter-affidavit it is requested by the learned counsel for the petitioners to dispose of the present writ petition with a liberty to avail the remedies open to them under law.

In view of the above, the writ petition stands disposed of, keeping it open for the petitioners herein to avail all the remedies available to them as per law. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
