THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1063 of 2016 ORDER:
This Contempt Case was filed alleging willful disobedience to the order dated 22.04.2016 passed by this Court in Writ Petition No.13619 of 2016. By the said order, this Court directed the police authorities to take necessary action upon the petitioner's complaint dated 16.04.2016 in the light of the law laid down by the Supreme Court in LALITA KUMARI v. GOVERNMENT OF UTTAR PRADESH[1].
The Inspector of Police, Hayathnagar Police Station, Cyberabad, filed a counter-affidavit stating that upon perusal of the petitioner's complaint, it was found that the offence alleged was a non-cognizable one. There upon, a requisition was filed before the learned VII Metropolitan Magistrate, Cyberabad and after receiving due permission, Petty Case Nos.404, 405 and 406 of 2016 were registered under Sections 323 and 506 IPC. In the light of the afore-stated developments, this Court finds no disobedience, much less willful disobedience, to the order passed by this Court warranting exercise of contempt jurisdiction.
The Contempt Case is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
