THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13131 OF 2017 O R D E R :

This Writ Petition is filed seeking a direction to the 1st respondent Commissioner, Sadasivpet Municipality to take action against the 2nd respondent, who is allegedly making constructions in violation of the approved plan, without leaving any setbacks, duly encroaching into the petitioner's house bearing No. 2-1-61/A, Gollakeri, Sadasivpet, Sanga Reddy District.

The case of the petitioner is that he has submitted representations dated 20.03.2017 and 24.03.2017 to the 1st respondent Commissioner complaining against the constructions made by the 2nd respondent, but so far, no action has been taken thereon.

Heard learned counsel for the petitioner as well as learned Standing Counsel for the 1st respondent Municipality. Since it is the case of the petitioner that he has already submitted representations to the 1st respondent against the illegal constructions carried on by the 2nd respondent, but no action has been taken thereon, it is appropriate to direct the 1st respondent to consider them and pass necessary orders thereon. The Writ Petition is therefore, disposed of directing the 1st respondent to consider the representations dated 20.03.2017 and 24.03.2017 of the petitioner and if the allegations made therein are found to be correct, necessary action, as enjoined under the Andhra Pradesh Municipalities Act, 1965, shall be initiated against the 2nd respondent. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
