HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION NO. 33331 OF 2018 O R D E R :

This Writ Petition is filed invoking the inherent jurisdiction of this Court under Article 226 of the Constitution of India seeking mandamus to declare the action of the second respondent in not taking any action on the representation dated 20/7/2018 against the illegal construction made by the third respondent by encroaching the road in survey No. 264 situated at Pedda Amberpet village, Hayathnagar Mandal, Ranga Reddy district, as illegal, arbitrary and contrary to law and consequently to direct the second respondent to demolish the illegal constructions made by the third respondent as stated supra and to pass such other suitable orders as this Court may deems fit and proper in the circumstances of the case.

2. Heard Sri I.V. Radhakrishna Murthy, learned counsel for the petitioners and the learned Government Pleader for Municipal Administration and Urban Development appearing for the respondents 1 and 2.

3. It is submitted by the learned counsel for the petitioners that for the redressal of the grievance, the petitioners herein submitted a representation to the Hyderabad Metro Development Authority, who is the second respondent herein on 20/7/2018

against the third respondent herein but no action is taken on the representation despite lapse of considerable length of time.

4. On the other hand, it is submitted by Sri V. Narasimha Goud, learned standing counsel for the second respondentHyderabad Metro Development Authority that if any such representation is pending consideration before the second respondent the same will be verified and appropriate action will be taken strictly in accordance with law.

5. Recording the said submission, the writ petition is disposed of at the stage of admission without expressing any opinion on the merits of the matter, directing the second respondent herein, to verify the representation dated 20/7/2018 said to have been submitted by the petitioners herein and take appropriate action/pass appropriate orders on merits and strictly in accordance with law after giving notice to all the stake-holders. However, there shall be no order as to costs.

6. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
