HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION Nos. 42462 & 42463 OF 2016 COMMON ORDER:
These two Writ Petitions are filed challenging the proceedings of the second respondent dated 7.10.2016.
This Court while issuing notice before admission on 20.12.2016 directed the second respondent not to dispossess the petitioners.
Today when the matter is taken up for consideration, the learned Government Pleader produced a copy of the letter from the Tahsildar addressed to the second respondent, wherein it was stated that the land involved in the present cases was handed over to the applicants pursuant to the interim order.
However, in view of the availability of the alternative remedy, against the orders of ejectment, petitioners are given three months time to prefer an appeal before the competent authority and as and when the petitioners avail such an alternative remedy by way of appeal, the competent authority shall consider the same and pass appropriate orders in accordance with law. Petitioners shall not be dispossessed for a period of three months from the date of receipt of a copy of this order.
Accordingly, these two Writ Petitions are disposed of. There shall be no order as to costs. As sequel thereto, Miscellaneous Petitions, pending if any, shall stand closed. ___________________________________ A. RAMALINGESWARA RAO, J DATE: 17.02.2017 KA
