HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.29836 of 2016 ORDER:

Vide the present petition, the petitioner questions the action of the respondents in issuing impugned proceedings dated 24.08.2016, in permitting respondent No.4 to provide diet to the inpatients and DMOs of respondent No.3 - E.S.I. Hospital, as illegal and arbitrary.

Learned counsel for the petitioner submits that the petitioner made representation dated 27.08.2016 to respondent No.3. However, no communication has been received by the petitioner so far.

Learned Government Pleader for Medical and Health, on advance notice, submits that the respondents have not received any representation from the petitioner and, if any representation is filed, the same shall be considered and disposed of. However, counsel for the petitioner disputes the same.

Be that as it may, the petitioner is at liberty to file another representation, if so advised. I hereby direct respondent No.3 to take decision within one week from the date of representation. The decision taken by respondent No.3 shall be communicated to the petitioner in writing within one week thereafter.

If the petitioner is still aggrieved by the decision of respondent No.3, liberty is granted to them to approach the appropriate forum.

Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
