Continuously, there is no representation for the appellant. On 23.01.2018, this Court, having noted the said fact, directed the matter to be listed today under the caption 'for dismissal'. Learned counsel for the respondent is present. Yet again, there is no representation for the appellant. Hence, it is evident from the record that the appellant is not interested in prosecuting the Appeal Suit. 2.

In the result, the Appeal Suit is dismissed for default. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.

There shall be no order as to costs.
