HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.34095 of 2013 ORDER:

This writ petition is filed to declare the action of respondents 1 and 2 in not removing the unauthorised constructions made by respondents Nos.3 to 5 which is constructed over the premises bearing Municipal H.No.4-1-1070, 1071, 1071/1 and 1071/2, Bogulkunta, Tilak Road, Hyderabad, as illegal and arbitrary.

The case of the petitioner is that respondents Nos.3 to 5, who are his neighbours, have constructed multi-storied building violating the sanctioned plan and in spite of making complaints to the official respondents, they have not taken any action. Hence, the writ petition. As the writ petition is of the year 2013, the petitioner is given liberty to file a fresh representation before the Assistant Commissioner, Municipal Corporation, Hyderabad, within a period of two weeks from the date of receipt of a copy of this order and the Assistant Commissioner is directed to consider the representation after giving due opportunity of hearing to the petitioner and respondent Nos.3 to 5 and pass appropriate orders, as expeditiously as possible, preferably within a period of eight weeks from the date of receipt of the representation.

With the above directions, the Writ Petition is disposed of. No order as to costs.
