THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO Crl.P.No.357 of 2015 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in D.V.C.No.02 of 2015 on the file of XIX Metropolitan Magistrate at Miyapur wherein reliefs have been sought by 2nd respondent against the petitioners and another under the Protection of Women from Domestic Violence Act, 2005.

2. Petitioners herein are A-2 to A-5 in the said case. The 2nd respondent's husband one Srikanth Reddy is 1st respondent in the said case.

3. It is alleged in the D.V.C. that 2nd respondent and the said Srikanth Reddy were married on 24-04-2014; that her husband is working in IBM, Bangalore as a software engineer and 2nd respondent is employed in Wipro Company in Chennai; and that due to certain reasons, the parties were not living together and that when the parties were living together, certain threats were made to 2nd respondent forcing her to seek certain reliefs under the above Act.

4. The learned counsel for the petitioners contended that there were no specific complaints against the petitioners and the complaint mostly appears to be only against Srikanth Reddy who is 1st respondent in the D.V.C. and the petitioners are falsely implicated in the case.

5. After perusing the contents of the application filed by 2nd respondent, I am of the opinion that the allegations therein cannot be said to be not entitling 2nd respondent to grant of relief under

the said Act. So, I am not inclined to quash the D.V.C. in exercise of powers under Section 482 Cr.P.C.

6. However, in the interest of justice, I deem it appropriate to permit the petitioners to be represented by counsel in the said proceeding subject to the condition that the petitioners shall appear as and when directed by the Court in the said proceeding. 7.

With the above observation, the Criminal Petition is dismissed.

8. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
