THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR CONTEMPT CASE No.1941 OF 2014 ORDER:
Learned counsel for the petitioners states that he is not pressing the Contempt Case so far as respondent No.3 in the Contempt Case is concerned.
Respondents 1 and 2 are being represented by learned Government Pleader. A counter affidavit is already filed by respondent No.2.
This Contempt Case is filed alleging violation of the interim order, dated 27.06.2014, passed by this Court in W.P.No.17565 of 2014, whereunder this Court granted interim directions in favour of the petitioners on the ground that a Division Bench of this Court had already granted interim directions to the petitioners in W.P.No.2674 of 2007, dated 13.02.2007.
Counter affidavit filed by respondent No.2 inter alia states that as the petitioners started construction in the existing Cart Track which is the Government land, respondent No.2 had protested the same and that there is no other interference by the respondents with regard to the land purchased by the present petitioners. A sketch map is also filed in colour showing that the petitioners land is the Government land and it is stated that to the extent of the petitioners land, there is no interference but, however, the Cart Track exists in the land, which belongs to the Government.
In any case, in view of the counter affidavit of respondent No.2 that there is no interference with the land purchased by the petitioners, nothing survives in this Contempt Case and the same is accordingly
dismissed.
Miscellaneous Petitions, if any, pending in this Contempt Case shall stand closed.
