THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.33106 of 2018 ORDER:

The main grievance of the writ petitioner in this writ petition filed under Article 226 of the Constitution of India is in relation to the inaction on the part of the 4th respondent-the Station House Officer, Utnoor Mandal, Adilabad, on the report/ complaint, dated 13.07.2018, lodged by the petitioner.

Heard the submissions of Sri M.A.K.Mukheed, learned counsel appearing for the petitioner; and, of the learned Government Pleader for Home (TS) appearing for the respondents 1 to 4. 3.

Learned counsel appearing for the petitioner submits that when the petitioner is carrying on agricultural operations in the land of the petitioner of a total extent of Ac.7.04 guntas, situated at Birsaipet Shivar of Utnoor Mandal, Adilabad District, interference is being caused by the persons named in the report/ complaint, dated 13.07.2018, and, yet, no action is taken by the police concerned. 4.

Learned Government Pleader for Home, on written instructions, dated 12.09.2018, a copy of which is placed on record, would submit that on verification of the records of the Police Station, it is noticed that no such report/ complaint, dated 13.07.2018, is found in the police station. He would further submit that if the petitioner furnishes the report/ complaint afresh or a copy of the report/ complaint, dated 13.07.2018, appropriate action would be taken.

Recording the said submissions, the Writ Petition is disposed of reserving liberty to the petitioner to submit a copy of the report/ complaint, dated 13.07.2018, to the Station House Officer, Utnoor Mandal, Adilabad District-4th respondent within a week from the date of receipt of a copy of this order. It is needless to state that in the event the petitioner submits a copy of such report/ complaint, the 4th respondent shall do the needful following the guidelines laid down in the Constitution Bench decision of the Supreme Court in Lalit a Kumari vs. Government of Ut t ar Pradesh1, whereunder, the law in connection with the registration of crimes has been summarized. There shall be no order as to costs.
