Company Application No. 502 of 2017 has been taken out to permit the petitioner to withdraw the Company Petition, subject to the respondent company complying with the terms of the memorandum of undertaking, with liberty to the petitioner to approach the appropriate forum/court to pursue the remedies available to him, if the situation warrants.

The Company Application is allowed. Consequently, the Company Petition is dismissed as withdrawn, preserving liberty as sought for. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
