HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31558 OF 2016 ORDER:
The case of the petitioners is that they have made a representation dated 03.09.2016 along with patta certificate dated 19.04.1985 issued by the Tahsildar, to the respondent authorities for issuance of pattadar pass books and title deeds and for mutation of their names in the revenue records in respect of the land admeasuring Ac.4-00 guntas in Sy.No.128 situated at Thattiannaram Village, Hayathnagar Mandal, Ranga Reddy District. As no orders are passed, the present writ petition is filed.
Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue submits that petitioners are claiming for pattadar pass books and title deeds basing on the patta certificate issued by the Tahsildar on 19.04.1985 but the 1st petitioner has no right to claim for the same since the lands are not transferable and only the claim of the 2nd petitioner can be considered in accordance with law.
In view of the same, without expressing any opinion on merits of the case, the respondent authorities are directed to dispose of the representation filed by the petitioner No.2 on 03.09.2016 within a period of six (06) weeks from the date of receipt of copy of this order and pass appropriate orders in accordance with law.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _________________________ A.RAJASHEKER REDDY,J 20-09-2016 dv
