HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40469 of 2016 ORDER:

The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to declare the action of the respondent police in calling the petitioner to the police station and threatening him with dire consequences and trying to interfere with the civil disputes, without any complaint against the petitioner, as arbitrary and illegal.

Heard and perused the material available on record. The main grievance of the petitioner is that he had some property disputes with his sister and in that connection some civil suites are also pending between them. At the instigation of the sister of the petitioner, the respondent police are calling the petitioner to the police station and insisting him to settle the issue with his sister and threatening him with dire consequences, without there being any complaint against the petitioner.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the respondents 2 and 3 are directed not to call the petitioner to the police station unless there is a complaint against him for a cognizable offence. With the above directions, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
