HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.925 of 2016 ORDER:

Heard the learned counsel for the petitioner/ Accused of Cr. No.269 of 2015 of Agiripalli Police Station, Krishna district, registered for the offences punishable under Sections 420 and 384 IPC, and also learned Public Prosecutor for the respondent and perused the First Information Report and the grounds urged in the petition.

It is one of the grievances of the petitioner that there are several documents seized on 16.12.2015 that reflects in the remands report of the accused/ petitioner and of which 4 documents which are Sl.Nos.10,11,13 and 15 now claimed ordered to be returned as those belong to the wife of the petitioner by name Ramadevi as the marriage of the daughter of the petitioner/ accused is settled and to perform the marriage, the property to be alienated.

Having regard to the above, the Criminal Petition is disposed of directing the investigating officer concerned to return the original documents as stated above, by obtaining Photostat copies with counter-signature of said Ramadevi and take said Photostat copies to their file and also take undertaking from them to produce in future if at all required. So far as the other contention is concerned, the non-filing of chargesheet pending for nearly two years by itself is not a ground to quash the

proceedings but for to urge after filing if at all aggrieved with part-II material with a direction to police to complete investigation and file chargesheet or otherwise, as the case may be, within two months from the date of receipt of the order. Consequently, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
