THE HON'BLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION NO.15545 OF 2024 This criminal petition is filed by the petitioner/A.1 seeking bail in connection with Cr.No.170 of 2024 of Hussaini Alam Police Station, Hyderabad. The offences alleged against him are under Sections 8 (c) r/w.20 (b) (ii) (C) of Narcotic Drugs and Psychotropic Substances Act, 1985.

The case of the prosecution is that the S.I of Police, P.S.Hussaini Alam gave complaint stating that on credible information on 28.08.2024, two individuals who were expected to deliver Hash Oil at Petlaburz, the police went to the scene of offence and found two persons on a two wheeler in suspicious circumstances and they were apprehended and identified as A.1 and A.2 and they seized 1 Kg of Hash oil in a polythene cover from their possession. A confessional and seizure panchanama was recorded in the presence of panchas. Basing on the complaint the above crime is registered against the petitioner for the said offences.

Heard Sri N.Srinivas, learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the respondent.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said offences and he is in jail from 28.08.2024.

Petitioner is ready to cooperate with the investigation. Further material part of investigation is already completed. As such, prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail and submitted that the seized contraband is a commercial quantity, investigation is not yet completed and petitioner is also involved in similar offences in two crimes and three offences under Indian Penal Code. As such, prayed this Court to dismiss this petition.

Having regard to the submissions made and the material on record, it is seen that petitioner is in jail from 28.08.2024 i.e., for the last four months, the alleged contraband seized is 1 kg Hash oil and that as material part of investigation is completed, and considering the period of incarceration in jail, by

the petitioner, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i. The petitioner shall execute a personal bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned Sessions Judge Hyderabad.

ii. The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner shall abide by the conditions stipulated in Section 482(2) of BNSS (previously known as Section 437 (3) of Cr.P.C.).

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
