It is submitted by the learned counsel for the petitioner as well as Mr. K. Ramakanth Reddy, learned standing counsel for the respondents that issue involved in this writ petition is squarely covered by judgment of this Court dated 17.12.2014 in W.P.No. 38803 of 2014, as in the present case also the impugned order was passed

without noticing the judgment of Supreme Court in RASHTRASANT T.M.S. & S.B.V.M.C.A.VID. & OTHERS v, GANGADAR NILKANT SHENDE AND OTHERS in Petition for Special leave to Appeal (Civil) Nos.42474248/2009, dated 10-09-2013. Hence following the said judgment, this writ petition is allowed, the impugned order is set aside and the matter is remitted to the first respondent for fresh consideration and passing appropriate orders in terms of NCTE Regulations, dated 28-11-2014. The first respondent is also at liberty to remit the matter to the second respondent if it feels necessary Miscellaneous applications, if any, shall stand closed. No order as to costs.
