This petition is filed under Section 24 of C.P.C to withdraw A.S.No.244 of 2004 from the file of the VII Additional District Judge, Eluru, West Godavari District and transfer the same to the Principal District Judge at Visakhapatnam.

2. When the matter is taken up for hearing, the learned counsel for petitioners sought permission of this Court to withdraw the transfer O.P. with liberty to the petitioners to avail all the remedies available to them under law.

3. Permission as sought for is accorded.

4. Accordingly, the Transfer Civil Miscellaneous Petition is dismissed as withdrawn with liberty as prayed for. No costs. Miscellaneous petitions, if any pending, in this petition shall stand closed.
