HON'BLE SRI JUSTICE T. AMARNATH GOUD CRIMINAL PETITION No.7034 of 2011 ORDER:

This criminal petition is filed by the petitioners, seeking to quash the proceedings in Cr.No.49 of 2011 on the file of Nagari Police Station, Chittoor District, registered against them for the alleged offence under Section 498-A IPC.

The 2nd respondent is the de-facto complainant and petitioners 1 to 3 herein are accused Nos.2, 5 and 6 in the said crime. The case has been registered for the offence under Section 498-A IPC and at the time of remand, on 20.06.2011, Section 494 was also included. The 2nd respondent/complainant alleged against the petitioners/accused about their harassment and, further, accused No.1-Mr.Sridhar married one Lakshmidevi, D/o.R.Ramaiah of Kothapalli village of Somala Mandal as second marriage and accused No.1 and the said Lakshmidevi were blessed with a male child. Since the matter requires investigation on the allegations made against the petitioners/accused, without expressing any merits on the case, the criminal petition is dismissed, directing the prosecution to proceed with the investigation in the crime in question in the light of Section 41-A Cr.P.C., and file final report. Till such time, the petitioners herein, i.e. accused Nos.A.2, A.5 and A.6 shall not be arrested.
