THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.13505 OF 2017 ORDER:

Petitioner claims that show cause notice along with suspension, which was signed on 02.05.2014, was served on him levelling certain allegations in performing his duties as Field Assistant. On 28.05.2014, petitioner submitted a detailed explanation justifying his claim. Thereafter, there is no further progress and petitioner continued to be under suspension and the proceedings are not concluded. According to learned counsel for the petitioner, there is no truth in the allegation. As the petitioner has already substantiated in his claim, disciplinary proceedings ought to have been concluded and he should have been re-inducted and continued in service.

Having regard to the fact that the order of suspension and show cause was issued on 02.05.2014 and there is no further progress, without expressing any opinion on contentions of petitioner, the Writ Petition is disposed of directing the respondents to complete the process and pass appropriate orders, as warranted by law, as expeditiously as possible preferably within a period of three weeks from the date of receipt of a copy of this order. For any reason, if no final orders are passed pursuant to the notice signed on 02.05.2014, petitioner should be reinstated into service by revoking the suspension without prejudice to continuation of disciplinary proceedings. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
