Order:

This contempt case is filed alleging willful disobedience of order dated 18.07.2013 in W.P.No.9936 of 2013. 2.

Mr.Neerabh Kumar Prasad, Special Chief Secretary to Government, Roads and Buildings Department, A.P., filed his affidavit, specifying the modalities for implementing the above mentioned order dated 18.07.2013 in W.P.No.9936 of 2013, which read as under:

(i). The Differential Geo Positioning System (DGPS) survey has already been conducted to demarcate the land required for the Road, and the maps were also authenticated by the Forest Department.

(ii). Accordingly, the Roads and Buildings Department have already uploaded the authenticated maps and other formats on 30.09.2018 in the Forest Department Portal.

(iii). The Forest Department will carry out the necessary internal works and it is expected that necessary orders will be issued by them within a period of 3 weeks time.

(iv).Simultaneously, the Executive Engineer is taking action for preparing estimates and the Chief Engineer (R&B), MDR after scrutiny will approve the estimate for laying the road from Km.6/0 to 7/0 of Kavali Kondapuram Road within 4 weeks, after receiving the necessary orders from the Forest Department. (v). Immediately there after, Superintending Engineer (R&B), Nellore will call for tenders by giving 14 days time and it is expected that the entrustment will be completed in another 2 weeks thereafter.

(vi.). On entrustment of work, work of laying road from Km 6/0 to 7/0 of Kavali Kondapuram Raod will be completed within 45 days.

The Special Chief Secretary stated that after completing the above undertaken measures, the restoration of Kavali Kondapuram road from Km 6/0 to 7/0, will be completed by 31.12.2018. 4.

In the light of the action plan given out by the Special Chief Secretary as indicated above, the contempt case is closed, however, with liberty to the petitioner to avail a fresh remedy, in the event of default of the respondents in restoring the road as per the action plan indicated by the Special Chief Secretary in his affidavit referred to above.
