HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3169 OF 2017 ORDER:

The learned counsel for the petitioner, Sri Bollam Lingaiah Yadav, commenced the arguments.

The learned Additional Public Prosecutor for the State of Telangana represents that the investigating officer laid charge-sheet on 7.3.2017 on the file of Judicial Magistrate of First Class, Devarakonda.

The learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to move similar application to challenge the proceedings in the charge-sheet. Permission is accorded and, accordingly, the Criminal Petition is dismissed as withdrawn granting liberty as sought for. The learned Judicial Magistrate of First Class, Devarakonda is also directed to consider the charge-sheet and pass appropriate orders as regards taking cognizance in accordance with law, within one week from the date of receipt of a copy of the order. As a sequel thereto, miscellaneous petitions if any pending in the criminal petition shall stand closed.
