THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.23910 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ of mandamus or any other appropriate writ, order or direction declaring the action of the respondents 2 to 7 in not taking steps to remove the unauthorized and illegal encroachments on the Santha Market Road situated in Sy.No.15/1 of Machavaram Ravavaram Mandal, East Godavari District to widen the said road and formation of C.C. road duly conducting the survey as proposed vide Resolution No.36 dt.14-07-2016 passed by the 5th respondent as illegal, arbitrary and unjust and consequently direct the respondents to conduct the necessary survey and remove the encroachments to widen and formation of C.C. road."

Heard learned counsel for the petitioner and learned Government Pleader for Panchayat Raj, representing the respondents 1 to 4 and Sri Ravi Cheemalapati, learned standing counsel for 5th respondent and learned Government Pleader for Revenue for the respondents 6 and 7 and perused the prayer in the writ petition with supporting affidavit. 3.

In support of the said prayer, it is the supporting affidavit averment that even the petitioner has given a written representation to the respondents 2 to 7, particularly to the

District Collector - 7th respondent, on 10.07.2017, no action has been taken and there is no intimation of any action taken.

Having regard to the above and from the submission of some of the encroachments removed and some in progress, as per the oral instructions of the learned standing counsel for the panchayat, the writ petition is disposed of, directing the 7th respondent - District Collector, to dispose of the representation of the petitioner by intimating the action taken pursuant to it within six weeks from the date of receipt of the order. Further grievance if any left open.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
