HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9302 of 2017 ORDER:

Heard learned counsel for the petitioner/accused No.3 of crime No.200 of 2017 of Korukonda Police Station, Rajahmundry Urban, registered for the offences punishable under Sections 498A, 323 r/w 34 IPC and also learned Public Prosecutor representing the 1st respondent-State and before ordering notice to the 2nd respondent-defacto complainant and perused the grounds urged in the quash petition and the contents of the FIR. A perusal of the material on record no way entitles this Court to interdict the investigation much less to admit the quash petition, but for to say pending investigation, the petitioner/A.3 shall not be arrested, however it will not prevent the police to secure the presence of the accused for the purpose of the investigation, by left open all available defence of the accused. Accordingly and in the result, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions, if any shall stand closed.
