Heard.
Aggrieved by the order of eviction passed by the 3rd respondent on 13-10-2015 under Section 6 of the A.P.Land Encroachment Act, the petitioners state that they have filed an appeal along with stay application on 19-10-2015 and the same is pending before the 2nd respondent. Alleging that no date of hearing is notified under the said appeal and that the 3rd respondent is trying to dispossess the petitioners by executing the order of eviction, the present writ petition is filed.
Keeping in view the facts and circumstances of the case and that the petitioners appeal is pending before the 2nd respondent since 19-10-2015, it is appropriate to direct the 2nd respondent to fix an early date of hearing preferably within one week from the date of receipt of a copy of this order, by notifying the petitioners and hear the appeal and the stay petition and pass appropriate orders, atleast to the extent of stay petition within one week thereafter. Till passing of the appropriate orders by the 2nd respondent as directed above, the impugned order of the 3rd respondent directing eviction of the petitioners, referred to above, shall not be enforced. Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.
