The writ petition is filed apprehending the appointment of third respondent as fair price shop dealer in the vacancy caused by the death of her father. It is submitted that the third respondent is residing at Hyderabad and she is having a guest house at Tirupati and doing gold business. The writ petition is filed on the basis of mere apprehension only and it cannot be maintained at this stage.

Accordingly, the writ petition is dismissed. However, if the third respondent is appointed, it is open for the petitioner to challenge her appointment on any of the available ground. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. ______________________________ A.
