Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for respondent-TSRTC.
This writ petition is filed seeking to declare the proceedings dated 19.06.2015 issued by the 3rd respondent in suspending the petitioner, as arbitrary and illegal.
The petitioner was appointed as Conductor in 1982 in respondent-Corporation and his services were regularized in 1984.
According to the respondent-Corporation, during the course of check exercised by the checking officials, the petitioner was found to have indulged in cash and ticket irregularities.
According to the petitioner, he never indulged in any cash and ticket irregularities and the checking officials, without taking into consideration the statements of the passengers, placed him under suspension.
In any event, to arrive at truth or otherwise of the issue involved, an enquiry needs to be
conducted.
Therefore, the respondent-Corporation is directed to initiate enquiry against the petitioner as per Rules and pass final order within a period of eight weeks from the date of receipt of a copy of this order. If the petitioner wants to examine the passengers as witnesses, the Enquiry Officer shall permit him to do so. Further, if the enquiry is not completed within the stipulated period, the order of suspension shall stand revoked.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, Miscellaneous Applications, if any, shall stand closed.
