O R D E R

Petitioner claims to be the legal hair of deceased Mahant of Sri Brahmachary Mutt (for short 'the Mutt'). His grievance is that unofficial respondents 6 to 10 are interfering with the day to day affairs of Mutt, situated in the subject property and that though he filed complaint dated 30.08.2018, respondents 2 to 5 - police authorities, are not registering the complaint and taking action in accordance with law. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of Sub Inspector of Police, Rajendranagar Police Station, Cyberabad, dated 14.09.

2018, stating that in respect of the affairs of the properties of the Mutt, already criminal cases are registered and pending and in view of the same, the 5th respondent - Station House Officer, Rajendranagar Police Station, Rajendra Nagar, Rangareddy District, did not register the complaint of the petitioner dated 30.08.2018 and in this connection, an entry was made in the general diary and the same was informed to the petitioner. The petitioner again lodged a complaint on 12.09.2018 with the 5th respondent against unofficial respondent No.6 and the same was registered as a case in Cr.No.1403 of 2017 dated 12.09.2017 under Sections 447 and 427 of IPC and investigation is in progress.

It is stated that the Executive Officer, Endowments Department, Sri Bramhachary Mutt, Rambagh, Attapur VIII Rajendranagar mandal, Rangareddy District, submitted a written report to the 5th respondent vide letter No.01/ SBM/ 2018 dated 13.09.

purview of the Endowments Act, 30/ 87 and the day to day affairs of the Mutt is being managed by the Executive Officer, Endowment Department. It was further mentioned in the report that the petitioners and others unnecessarily involving into the day to day administration of the mutt and giving complaints against others to the police authorities / government departments, with regard to protection and properties of the Mutt, which is creating law and order problem in the vicinity and also difficulty to the Endowment Department. With these instructions and denying the allegations of the petitioner, the writ petition was sought to be dismissed.

Recording the statement made in the written instructions, writ petition is disposed of, giving liberty to the petitioner to avail alternative remedies available under law.

Interlocutory applications pending, if any, shall stand closed. No costs.
