THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.255 of 2013 ORDER:

Heard the learned counsel for petitioner and the learned Standing Counsel for respondents 1 and 2.

2. This writ petition was filed challenging the proceedings of the third respondent dated 19.12.2012 cancelling the license of the petitioner under Section 7(1) of the Essential Commodities Act, 1955 (for short, the Act).

3. Though in the subject it was mentioned as Section 7(1) of the Act, the order was passed for violating Rule 18 of the Seeds (Control) Order, 1983 read with Rule 15 thereof. Even as per the impugned order, the license of the petitioner is valid upto 26.12.2014. This Court, by order dated 03.01.2013, while ordering notice before admission, granted interim suspension of the said order. Now WVMP.No.3685 of 2013 is filed by the learned Standing Counsel seeking vacation of the interim order.

4. In view of the expiry of the original license on 26.12.2014, no further orders need be passed in the writ petition, and therefore, the writ petition is dismissed as infructuous. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
