HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.33464 of 2018 ORDER:

This writ petition is filed assailing the order dated 27-082018 passed by the respondent-District Registrar, Hyderabad, in refusing to receive, register and record the names of the governing council of the petitioner-society stated to be elected on 17-09-2017 as being illegal, arbitrary and for issuance of appropriate directions in the interest of justice. It is the case of the petitioner-society that it submitted a list of members of governing council, office bearers of governing council as contemplated under Section 9 of the Societies Registration Act, 2001 and though the respondent is mandated under law to enter the information furnished in the records, the respondent refused to do so without any just cause and intimated the refusal by the impugned order. Hence this writ petition.

Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader for Revenue submits that the application of the petitioner informing to note the change of governing council etc. could not be acted upon as the application is not accompanied with the required documents including no dispute letter between the office bearers of the outgoing and incoming members of the petitioner-society.

In such view of the matter, the writ petition is disposed of and it is open for the petitioner to make a fresh application under Section 9 of the Act by furnishing the required particulars and by enclosing the necessary documents in support of change of governing council of the society including the letter indicating no dispute between the out-going and incoming members and on such an application being filed by the petitioner, it is for the respondent to consider the same and pass orders thereon and take action in accordance with Section 9 of the Act. As a sequel to the disposal of this writ petition, miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
