CVNR, J & TR, J OSA.No.14 of 2013 JUDGMENT: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This appeal is filed against the order dated 19.03.2013 in CP.No.171 of 2009 whereby the learned company Judge has admitted the company petition and ordered publication of admission. 2.

At the hearing, learned counsel for the respondents submitted that in pursuance of the order of the learned company Judge, the publication was made and the trial is completed after forfeiting the right of the appellant to cross-examine the witnesses and that the company petition is coming up for arguments.

Mr. Bala Naga Srinivas, learned counsel representing Mr. Vedula Venkataramana, learned senior counsel for the appellant, submitted that despite their best efforts they are unable to secure instructions from the management of the appellant.

As evident from the proceeding sheet, the case is being adjourned from time to time at the request of the learned counsel for the appellant for instructions. As no instructions are reported, we are left with no option other than dismissing the appeal for non-prosecution.

Accordingly, the original side appeal is dismissed for non-prosecution.

As a sequel to the dismissal of the appeal, OSAMP.No.314 of 2013 shall stand dismissed as infructuous.
