HONOURABLE SRI JUSTICE N. BALAYOGI CRIMINAL PETITION No.6629 OF 2011 ORDER:

This Criminal Petition under Section 482 Cr.P.C. is filed to quash the proceedings in CC.No.234 of 2009 on the file of learned Judicial Magistrate of First class, Koilakuntla, Kurnool district.

When the matter was posted for hearing on 22.09.2017 learned Counsel for the petitioner sought for adjournment and accordingly the matter was directed to be listed to 25.10.2017 finally. On the said date, though the matter was listed for hearing finally, none appeared for the petitioner nor is made any representation on behalf of the petitioner. In the circumstances, the matter was directed to be listed under the caption 'for dismissal' in the first week of November, 2017. Thereafter the matter was adjourned to 3.1.2018, 23.01.2018, 24.01.2018 and finally to 31.1.2018. Even today also, though the matter is listed finally under the caption 'for dismissal' learned Counsel for the petitioner is seeking adjournment. It appears that the petitioner is not interested to argue the matter. In the circumstances, this Court has no option except to dismiss the Criminal Petition for non prosecution.

Accordingly, the Criminal Petition is dismissed for non-prosecution.

Interim stay granted on 21.10.2011 stands vacated.
