THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.39992 of 2016 ORDER:
Petitioner has assailed the orders dt.19-10-2016 in P.W.I.A.No.4 of 2016 in P.W.No.6 of 2015 on his filed declining to grant relief under Order 12 Rule 16 C.P.C. and pass judgment at the instance of the petitioner.

Learned counsel for petitioner contends that entire proceeding before the 2nd respondent ought to be decided as per first proviso to sub-Section (3) of Section 15 of the Payment of Wages Act, 1936 within three (03) months from the date of registration of claim by 2nd respondent; that in the present case, the claim was preferred by petitioner before the 2nd respondent on 26-08-2015, but the 2nd respondent is not keeping in mind the time limit stipulated above and has kept the claim filed by petitioner pending even though more than a year has elapsed.

Prima facie, I find substance in the contention of the learned counsel for petitioner.

Therefore the Writ Petition is disposed of directing the 2nd respondent to decide P.W.No.6 of 2015 pending on his file within three (03) months from the date of receipt of a copy of this order positively. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
