THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14878 of 2025 This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS) by the petitioners in the event of their arrest in connection with FIR No.469 of 2025 of Kamareddy Town Police Station, Kamareddy District, registered for the offences punishable under Sections 337, 338, 336(3), 340(2), 318(4) r/w 3(5) of the BNS.

The brief facts of the case are that, on 23.08.2025, the de-facto complainant, who is the Tahsildar, lodged a report before the police stating that, on verification of office records i.e., the Distribution Register (DR) for the year 2024, it was found that DR No.1596, which was mentioned in the family member certificate was fake and not issued by the office and in fact, the DR number was allotted to Sri Vislawath Devender Babu Nayak for the Succession and in the said family member certificate, they mentioned wrongly the DR number and it is a forged document. Hence, he requested for necessary action. Basing on the
said complaint, the police registered a case for the above said offences and the accused No.1 was already remanded to the judicial custody and was granted bail by the trial Court.

Heard Sri Praveen Kumar Challa, learned counsel for the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent- State.

Learned counsel for the petitioners submitted that the petitioner No.1/accused No.2 is aged about 80 years and the petitioner No.2/accused No.3 is 19 years old student and they are no way connected with the said forgery of the family member certificate and whatever, the allegations are only against the accused No.1 and she was already arrested and released on bail and the petitioners herein are ready to cooperate with the investigation. Therefore, he prayed the Court to grant anticipatory bail to the petitioners. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned
counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature and the custodial interrogation of these petitioners is required for further investigation. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner No.1/accused No.2 is aged about 80 years and the petitioner No.2/accused No.3 is 19 years old student and on the date of offence, she was minor and the allegations against the petitioners herein are that the family member certificate which was used for transfer of the property is a forged document and accused No.1 was already arrested and was released on bail and whatever, the investigation is there, it is only the documentary investigation. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners/accused Nos.2 and 3, subject to the following conditions:
i.
The petitioners/accused Nos.2 and 3 shall surrender before the Station House Officer, Kamareddy Town Police Station, Kamareddy District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioners/accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners/accused Nos.2 and 3 shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and
05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
