Adireddy Umadevi v. The Tahsildar

HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33184 of 2018 ORDER:

The present writ petition came to be filed seeking the following relief:

" To declare the action of the respondent no. 1 in interfering with the agricultural operations of the petitioners over the land extent Ac.2.00 cents each situated in Sy.No.565/ 1, 565/ 2 and 662/ 3 Diguvanelaturu Village, Brahmamgari Matham Mandal, YSR Kadapa District without following due process of law, as arbitrary, illegal and consequently direct the respondent No.1 not to interfere in the agricultural operations of the petitioners over the land extent Ac.2.00 cents each situated in Sy.No.565/ 1, 565/ 2 and 662/ 3 Diguvanelaturu Village, Brahmamgari Matham Mandal, YSR Kadapa District without following due process of law."

The learned counsel for the petitioners mainly submits that the petitioners are in possession of the subject lands and any action to be taken by the respondents to dispossess them shall be only in accordance with law.

Learned Government Pleader would submit that the assignments granted to the petitioners are fake and that the

District Collector has already initiated enquiry into the alleged assignments granted to the petitioners.

Having regard to the above, the writ petition is disposed of at the admission stage, holding that if the petitioners are in possession of the subject lands, any action taken by the respondents to dispossess them shall be only in accordance with law. It is needless to mention that it is always open to the District Collector to expedite the enquiry proceedings with respect to the assignments granted to the petitioners, as per law. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
