ORDER
The present criminal revision case is directed against the docket order dated 04.01.2016 passed in Cr.No.333 of 2015 of II Town Police Station, Rajahmundry, by the learned VI Additional Judicial Magistrate of First Class, Rajahmundry.
2. Heard and perused the material on record.
3. The petitioners/A3 and A4 are involved in Cr.No.333 of 2015 of II Town Police Station, Rajahmundry, registered for the offences punishable under Sections 406, 420 read with Sections 120(B) and 34 IPC. While granting bail to the petitioners, this Court directed them to appear before the Station House Officer concerned everyday. Since the petitioners failed to comply with the said direction, the de facto complainant filed a memo before the trial Court seeking to take necessary action against them. By the order impugned, the trial Court issued notices to the sureties of the petitioners and also to the concerned Station House Officer directing them to give explanations. Challenging the same, the present revision is filed.
4. Learned counsel for the petitioners submits that due to ill-health and unavoidable circumstances, the petitioners could not able to appear before the concerned Station House Officer.
5. Considering the facts and circumstances of the case and in view of the nature of offence, this Court is inclined to set aside the
order impugned. In view of the same, the order impugned is hereby set aside and the condition imposed by this Court while granting bail to the petitioners/A3 and A4 directing them to appear before the concerned Station House Officer everyday, is also hereby set aside.
6. Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions, if any, pending in this revision shall stand closed.
