Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the inaction of the 3rd respondent-Revenue Divisional Officer in suspending his authorisation as fair price shop dealer of the fair price shop No.6 of Kota Village, Edlapadu Mandal, Guntur District, by proceedings dated 20.02.2015, as illegal and arbitrary and for a consequential direction to the respondents to allow the petitioner to continue as fair price shop dealer.

3. At the time of inspection of the fair price shop of the petitioner by the authorities, certain irregularities in the stock have been noticed. Learned counsel appearing for the petitioner would submit that the variations pointed out at the time of inspection are very minor and permissible under the Control Order, 2008. On the other hand, learned Government Pleader for the Civil Supplies (AP) would submit that apart from it, there are other allegations against the petitioner that instead of obtaining the signatures of the cardholders, he obtained their thumb marks. The petitioner gave an explanation to the effect that due to pressure of work, he could not obtain the signatures of the cardholders.

Having regard to the nature of the allegations levelled against the petitioner, this Court is of the view that the allegations mentioned in the respective charges do not warrant any suspension of the authorisation of the petitioner and the impugned order therefore requires interference by this Court.

5. The writ petition is accordingly allowed setting aside the impugned order dated 20.02.2015 passed by the 3rd respondentRevenue Divisional Officer, Narasaraopet, Guntur District.

Miscellaneous applications, if any, shall stand closed. No order as to costs.
