THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1675 OF 2016 ORDER:

This revision is filed by the petitioner challenging the order dated 31.3.2016 passed in C.F.R.No.2123 of 2016 by the Judicial First Class Magistrate, Banaganapalle.

It is stated that in pursuance of the orders of this Court in Criminal Petitions No.6055 and 7827 of 2014, the petitioner deposited her passport on 30.9.2014 and subsequently, the petitioner filed Crl.P.Nos.5922 and 5923 of 2015 before this Court for relaxations of conditions earlier imposed in Crl.P.Nos.6055 and 7827 of 2014. This Court relaxed the conditions as prayed by the petitioner. Hence, the petitioner filed the above CFR before the Court below seeking to return her passport.

The Court below has not entertained the said application. Aggrieved by the same, the petitioner filed this revision. Heard and perused the material available on record. Considering the facts and circumstances of the case, the petitioner is directed to file an affidavit before the Court below informing the date on which she intends to go to abroad and the date of her return to India and the date of surrender of her passport before the Court below. On such affidavit being filed, the Court below is directed to return the passport of the petitioner and permit her to go to abroad.

Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions filed in this revision, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 29.6.2016 Nn
