HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.12465 of 2013 ORDER:

In this petition filed under Section 482 Cr.P.C, the petitioners/A.1 to A.4 seek to quash the FIR in Crime No.306 of 2013 of Jammikunta P.S, Karimnagar, which was registered against them for the offence under Sec.384 r/w 34 IPC.

2) The Police registered the FIR on the strength of the complaint given by Chiluka Rajender alleging that when himself and his villagers were transporting sand in their tractors from Manair Vaagu to the Government works and Indiramma housing works, the accused persons obstructed them and demanded them that they were transporting the sand through their fields and therefore, they have to pay money or otherwise they would burn their tractors and kill them and due to fear, the complainant and his co-villagers paid Rs.1,72,000/- to them. During this year also when the complainant and others were transporting sand, the accused came and extorted money from them and when they refused, the accused filed some false cases against the complainant and others under S.C, S.T (POA) Act. The complainant thus prayed to take action against the accused. The petitioners/A.1 to A.4 filed the instant petition to quash the FIR.

3) When the matter came up for hearing today, learned Public Prosecutor submitted that in this case investigation was completed and charge sheet was filed by the police for the offence under Sec.384 r/w 34 IPC against the accused and learned Additional Judicial First Class Magistrate, Huzurabad took cognizance of the offence and registered as C.C.No.164 of 2014. Learned Public Prosecutor produced copy of the charge sheet and submitted that the petition which is filed to quash the FIR has become infructuous and prayed to dismiss the petition.

4) There is no representation for petitioners.

5) In view of the above submission of learned Public Prosecutor, this Criminal Petition is dismissed as Infructuous.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
