HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.43056 of 2016 Order:

This Writ Petition was filed for a Writ of Certiorari calling for the records relating to Crime No.98 of 2016, dated 25.05.2016, on the file of the second respondent Police Station.

Though the second respondent did not file any counter, the third respondent filed a counter stating that after registration of the crime a charge sheet was also filed on 25.09.2016 in the Court of the II Additional Magistrate of First Class and the present Writ Petition was filed suppressing the said fact. The charge sheet is numbered as C.C.No.598 of 2016 before the said Court and the trial is pending. It is further stated that the third respondent filed O.S.No.93 of 2016 for recovery of possession of the property on the file of the IX Additional District Judge, at Rajamahendravaram, East Godavari district and the same is also pending.

In view of the above facts, no further enquiry is warranted in the present Writ Petition and the Writ Petition is, accordingly, closed giving liberty to the petitioners to take appropriate legal proceedings in accordance with law. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
