Heard Mr.Mithileshwara Reddy for petitioner and Mr.Butta Vijay Bhaskar for respondents.

The petitioner challenges order dated 18.11.2016 in I.A. No.159 of 2016 wherein the trial Court directed the petitioner to deposit 1/ 4th of the decretal amount as condition to set aside the default order dated 06.10.2015.

On 16.03.2017, the following order was passed: "At request of the respondents, post on 24-03-2017. The request of petitioner to deposit 1/4th of the decretal amount, as directed by the trial court, forthwith to the credit of O.S.No.2 of 2012 is accepted.

The petitioner is directed to deposit 1/4th of the decretal amount on or before 23-03-2017 and file proof of payment by the next date of hearing."

The petitioner places on record Challan No.479 dated 23.03.2017 showing compliance of deposit of 1/ 4th amount. The C.R.P. is ordered by restoring O.S. No.2 of 2012 to file and the trial Court is directed to decide the suit on or before 31.07.2017 without fail.

The C.R.P. is ordered accordingly. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT,J Date:24.03.2017 Stp
