THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9597 of 2015 ORDER:
This criminal petition is filed by the petitioner - Accused under Section 438 of Criminal Procedure Code seeking to grant bail in Crime No.190 of 2015 on the file of Medikonduru Police Station, Guntur Urban, registered for the offences punishable under Sections 420 and 406 IPC.
Heard and perused the material available on record. The case of the prosecution is that the de facto complainant is a manufacturer of soap Noodles on job work to ITC limited and they receive the raw material from the said company and that on 28.05.2015 they noticed the concealed compartments of the tanker were filled with water instead of edible oil, which is used to manufacture the soap noodles.
Learned counsel for the petitioner submitted that the alleged pilferage was done by the driver of the tanker and that the petitioner is the owner of the said vehicle and he is no way concerned with the said offence and the vehicle is also seized by the police.
Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner.
In the circumstances, the petitioner - accused is directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender he shall be enlarged on bail on his executing a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the like sum to the satisfaction of the said Magistrate. The petitioner is further directed to report before the Station House Officer concerned, daily between 10 a.m. and 5 p.m., until further order from the date of receipt of a copy of this order.
Accordingly, the Criminal Petition is allowed. ______________
