This Criminal Petition is filed praying this Court to enlarge the petitioners on bail who are arrayed as accused Nos.11 and 16 in Crime No.147 of 2025 of Zaheerabad Town Police Station, Sangareddy District, registered for the offences punishable under Sections 8(c) read with 22(c), 27(A) and 29 of NDPS Act.

The brief facts of the case are that on 15.05.2025, the SubInspector of Police, Zaheerabad Town Police Station, received credible information that a person was transporting Alprazolam from Pune to Zaheerabad to deliver it to a customer arriving in a car bearing

No.TS09 EV 7353. Basing on the information, the police apprehended two persons near Indraprastha Venture Road, Zaheerabad, and seized 770 grams of Alprazolam and Rs.7,50,000/- in cash. Basing on the confession of those arrested, the present petitioners were shown as accused Nos.11 and 16.

Heard Sri K. Venumadhav, learned counsel for petitioners, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners were falsely implicated solely on the basis of the confessional statements of co-accused, without any independent evidence linking them to the alleged offence and that similar cases registered against the petitioners in other police stations for the same offences had already resulted in their release on bail. He further submitted that the investigation was substantially completed, the petitioners had been in custody since 08.07.2025 and 09.07.2025, and that their continued detention served no purpose. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the petitioners are the drug peddlers. He further

submitted that the investigation is in progress and if the petitioners are released on bail, at this stage, they may tamper with the evidence and may threaten the witnesses. Hence, he prayed the Court to dismiss the criminal petition.

Having regard to rival submissions made, and on going through the material placed on record, it is noted that the contention of learned counsel for petitioners is that initially they were arrested in connection with COR.No.48 of 2025 for the same quantity of Alprazolam, wherein, the accused No.11 herein was shown as accused No.1 and there also there was no seizure of contraband from the accused, and similar to said offences, the present case is also registered against the petitioners before the Zaheerabad Police Station. The allegations against the petitioners are that they are working in toddy shop which belongs to some other person and knowingly the toddy was adulterated by them which was used to supply in their village and surrounding villages. 7.

On perusing the material on record, it is seen that there is no recovery from the petitioners and as on the date of registration of this crime, the petitioners were already in jail in relation to earlier crime and they are already released on bail in the said case. Therefore, considering the facts and circumstances of this case in entirety, this Court deems it fit to grant bail to the petitioners, subject to following the below conditions:

i.

The petitioners shall execute a personal bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of the Additional Judicial Magistrate of First Class, at Zaheerabad, Sanga Reddy District.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required. iii.

The petitioners shall abide by the conditions stipulated in Section 480(3) of the BNSS, earlier known as Section 437(3) of Cr.P.C.
