THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.33123 OF 2018 ORDER: (per SK,J) The State of Andhra Pradesh and its authorities in the Forest Department filed this writ petition aggrieved by the interim order dated 20.07.2017 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.2083 of 2017.

Heard the learned Government Pleader for Services, Andhra Pradesh, and Sri P.V.Ramana, learned counsel on caveat for the respondent.

We find from the record that the order under challenge is an interim order passed by the Tribunal as long back as on 20.07.2017. Learned Government Pleader fairly states that no vacate miscellaneous application has been filed in the said O.A. till date. Without taking necessary steps to have the matter adjudicated by the Tribunal in the first instance, it is not open to the State and its authorities to straight away come before this Court. On this short ground, we refuse to entertain the writ petition and dismiss the same. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
