THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35171 of 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 2 to 4 in not taking up any investigation in crime No.53 of 2016 as illegal, arbitrary and violative of principles of natural justice and consequently to direct the respondents 2 to 4 to investigate the matter and to encash the Demand Drafts to the tune of Rs.24,92,251/-.
Heard and perused the material.
Learned counsel for the petitioner submits that though the complaint given by the petitioner is registered, the respondents 2 to 4 are not conducting any investigation and as such, seeks prays this Court to direct the respondents 2 to 4 to conduct investigation. Learned Assistant Government Pleader for Home (Telangana) submits that the investigation is in progress and the police will file the final report after completion of the investigation. Considering the facts and circumstances of the case, the fourth respondent is directed to conduct effective investigation and file final report, if any, in accordance with law, as expeditiously as possible, preferably with a period of three months.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 19.10.2016 pln
