THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 1353 of 2017 ORDER:

This writ petition is filed for the following relief: "....to issue an appropriate writ, order or direction, more particularly one in the nature of writ of mandamus, declaring the inaction of respondent No.3 in taking action against the unofficial respondents who have break open the lock of the premises of the petitioner bearing D.No.2-31, situated at Salveed Village, Kulkacherla Mandal, Vikarabad District, damaged and taken away the main door and committed theft of food grains and other household articles, motor and electrical accessories in spite of the written complaint, dated 07.12.2016 followed by repeated visits, as being illegal, arbitrary and unconstitutional and consequently direct respondent No.3 to forthwith act upon the complaint, dated 07.12.2016, and take action in accordance with law....." Learned Government Pleader for Home, on the basis of written instructions, submits that the petitioner neither approached the police nor filed the complaint.

In the circumstances, no order can be passed except giving opportunity to the petitioner to approach the Police concerned and give a fresh complaint, if he so desires.

The writ petition is accordingly closed.
