THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.33145 OF 2018 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue appropriate writ or order more particularly one in the nature of writ of MANDAMUS by declaring the revised selection of Group-II Services of Notification No 10/1999 in revised selection list dated 09.06.2017, as contrary to the judgement of the Hon'ble Supreme Court of India in Civil Appeal No.5099 of 2006 dated 18.02.2015 and declare same as illegal, arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India and consequently hold that the petitioner is entitled to hold the present post with all consequential benefits and to pass such other order or orders as this Hon'ble Court may deem fit, just and proper in the circumstances of the case.'
The controversy in this writ petition is in relation to a notification dating back to the year 1999.
Sri C.Srinivasa Baba, learned standing counsel for the Andhra Pradesh Service Commission, would inform this Court that the issue came up for consideration before the Supreme Court and a One Man Committee comprising Hon'ble Sri Justice C.K.Thakker, former Supreme Court Judge, was constituted to look into the matter on an individual basis. A copy of the order dated 24.07.2018 passed by the Supreme Court in this regard in Contempt Case (c) No.1700 of 2017 and batch is placed before us and perusal thereof bears out that the Supreme Court directed that until a report was given by the One Man Committee, the States of Telangana and Andhra Pradesh should maintain status quo. The
Supreme Court further directed that all employees/candidates concerned would have to appear before the One Man Committee so that a comprehensive report could be furnished to the Supreme Court after consideration of all issues.
In the light of this order and the developments that ensued pursuant thereto, it is for the petitioner to appear before Hon'ble Sri Justice C.K.Thakker and canvas his grievance. He cannot independently seek adjudication of the said grievance by this Court when the Supreme Court is seized of the matter.
